The development of the law over recent years
There have, over recent years, been numerous actions against Children’s Homes (both private and local authority), foster placements, churches and Local Authorities in respect of the abuse and maltreatment of children that have developed the law in this area. These claims have brought with them a recognition that widespread child abuse has been occurring in a variety of residential settings and the effects of the abuse upon the survivor can be serious.
The most recent significant case has been the House of Lords decision in A – v – Iorworth Hoare: C – v – Middlesborough Council: X & Anor – v – Wandsworth LBC: H – v – Suffolk County Council: Young – v – Catholic Care (Diocese of Leeds) (2008).
